Indicted Texas Gov. Rick Perry Heads to Court

Texas Gov. Rick Perry is making his first court appearance on felony charges that accuse him of abusing his power when he vetoed funding for public corruption prosecutors.

The potential 2016 presidential contender will be at a hearing Thursday in Austin. The Republican has said the charges are politically motivated and has asked for the case to be dismissed.

Perry was indicted in August by an Austin grand jury. He's accused of carrying out a threat to veto $7.5 million for a public corruption division within the office of Travis County District Attorney Rosemary Lehmberg after she refused to resign following a drunken-driving conviction.

The judge is expected to decide Thursday whether to dismiss the charges on a technicality. Perry was allowed to skip two previous pretrial hearings.

Dismissing the charge on a “technicality?” The abuse of power by a prosecutor to hijack the criminal justice system for a political “show trial” worthy of Joseph Stalin is no “technicality.”

The "technicality" being that no law was broken, even if the prosecutors prove everything they allege, mind you.

the judge presiding over the indictment, Bert Richardson, may not be on this case much longer since he was elected to the Court of Criminal Appeals on Tuesday.

While multiple reasons for dismissing the charges are being pursued, Gov. Perry’s lawyers are also including technicalities that may be the quickest route of dismissal.

Perry’s defense team is expected to present evidence they believe shows that the special prosecutor on the case, Michael McCrum, did not take a proper oath of office. McCrum says he was sworn in properly. Perry’s lawyers are also asking for a transcript of grand jury testimony to be provided to Visiting Judge Bert Richardson.

INDICTED TEXAS GOV RICK PERRY

That’s all the Dems believe they will need to oust him from being a future Presidential contender. They may be right. Remember, it’s the seriousness of the charge, not the nature of the (complete lack of ) evidence.

Obviously good lawyers will pursue every possible alternative to obtain a favorable outcome. My objection was with the tone of the article that made it sound as though Gov. Perry was an otherwise guilty person who would “get off on a technicality,” when the real issue is what I stated.

Tony Buzbee, who is the lead counsel on Perry’s defense team, said that Perry wants Richardson to review the grand jury transcripts to determine whether Perry’s prosecution is based upon discussions that fall under the Texas Constitution’s speech or debate clause, which grants immunity to legislators. Perry previously argued that the privilege bars his prosecution.

“The whole purpose of that speech or debate clause privilege is certainly … you cannot sue someone civilly,” explained Buzbee, owner and managing partner of The Buzbee Law Firm in Houston. “But there’s also immunity for using any of those statements for the basis for a criminal prosecution.”

A sound legal strategy since it appears to be a Constitutionally protected act, which is in the Texas Constitution for reasons made all too obvious by this abuse of process. However, as we see with the tenor of the article, the democrat/communist news/entertainment/academia comlex already has it’s meme:

“Got off on a technicality.”

The problem with “technicalities” is people ASSUME you are guilty even though it was never proven. Basically you are assumed guilty by the power of suggestion.
