Shawnee County Court rules Democrats don’t need Kansas Senate nominee

A Kansas court has ruled that Democrats can go without a U.S. Senate candidate after their nominee dropped out of the race against three-term Republican Sen. Pat Roberts.

The ruling Wednesday is a blow to the GOP in a key race in the national battle over Senate control.

A panel of three Shawnee County District Court judges said a state election law does not require Democrats to fill the candidate vacancy.

The judges also said the disgruntled who filed a lawsuit to force Democrats to act didn’t prove his case because he failed to show up for a Monday hearing.

Some Democrats pushed their nominee out of the race because they saw independent candidate Greg Orman as the stronger rival for Roberts and didn’t want to split the anti-Roberts vote.

It is also clearly contrary to the law (either allowing him to drop, or not replacing his name). But these are Dimocrats. They do not have to follow the law.

He isn’t Superman.
He is a liberal in disguise running on a populist theme.
He will screw up eventually, by not answering questions people will be wary of another ‘Obama-like’ candidate that is just ‘present’................

Shawnee County, KS (aka Topeka, KS, KS State Capitol full of, no jammed-packed with liberals, as are most State Capitol districts. Most residents aka voters are desiring more government not less!)

The RATS have a candidate, his name is Orman. He was their spoiler, but when their “name” candidate blew up, they had to fall back on their Trojan Horse. Now the RATS are just hoping voters won’t notice that Orman is a greasy hedge fund criminal until the election. Just like they’re hoping voters won’t care if their gubernatorial candidate was busted in a strip club back room with a naked woman.

Amazing.

The statute is one page long, and clear as a bell. First, a candidate has to give a reason why he/she could not perform the duties of the office, before dropping out. Second, and absolutely clear...a party has to put up a replacement candidate.

25-3905. Vacancies after primary election filled by party committee or district convention; governor and lieutenant governor vacancies filled by state party delegate convention. (a) When a vacancy occurs after a primary election in a party candidacy, such vacancy shall be filled by the party committee of the congressional district, county or state, as the case may be
