Montana's attorney general plans to appeal a judge's ruling that a voter-approved law requiring immigration checks of anybody applying for state services goes against federal immigration laws.

The 2011 Republican-led Legislature wrote the proposal meant to deny government jobs and assistance to people who are in the U.S. illegally. Legislators sent the plan to the 2012 ballot, where the referendum passed with nearly 80 percent of the vote.

District Judge Jeffrey Sherlock ruled in June the state law attempts to regulate immigration, which is exclusively a federal power.

Is this clown "judge" on drugs or what? What does food stamps and cash assistance have to do with immigration? This clown is a fool. Another moron on the bench. The law says you must be a U.S. citizen to climb up on to the wagon being pulled by the U.S. taxpayers. Making them prove that they are a U.S. citizen doesn't have a damn thing to do with "immigration".

Way too many Kalifornians have moved to Montana and brought their progressive ways with them.

Article 3
section 2
“In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction.”

Just because the Supreme Court refuses to FOLLOW the Constitution, does not mean the STATES have to go along with it.

Tell The Inferior Court to POUND SAND, then Arrest The Judge if he attempts to issue ANY ORDER that VIOLATES THE CONSTITUTION, He has also read this and Doesn’t care, so Arrest him anyway.

Were the I-9 laws reversed? I was doing payroll back in the late 80’s when we were required to confirm the eligibility to work of every individual. We had to make copies of passports & visas, drivers licenses, everything. Documentation, including the completed I-9 form, had to be kept on file for years. It was required by LAW.

How is it different today??!!!

And if the state refuses ... the citizens don't.

It all comes down to me ... what will I do ?

THAT'S the question to be answered by every man these days ... and we'd better make up our minds pretty damned quick, too.

I agree,
this could be changed easily by a Governor willing to mix it up, just answer every last question asked by the Media with the DIRECT quotation from the Constitution.
Watch them squirm

Shakespeare had it half right. The first thing we do is kill all the judges. Just quoting the bard.

This was settled back in the 80s when the court ruled that Texas had to educate the illegal children.

That decision was the precedent that the court used to overturn Prop 187 in California.

Nothing of the sort is settled, jail the judge, charge with him a State Crime of attempting to overthrow the State of Montana, then convict him and let him sit on Death Row, Force the President to issue a Pardon.

At the very least the Governor could send the State Police over to shoot his dog.
