I think it would be nearly impossible to hit arms extended above that many times, intentionally or not, but the arms are often hit by misses aimed at center mass, especially when the target is moving.
Unless I see compelling contradictory evidence, I am convinced by the locations of the wounds that he didn't have his hands up.
