First, there should never be a question to begin with. Second, how long before some lib/socialist/prog/commie activist judge tosses out the voters desire. Kinda like Kalifornia where the voters said no to a question on their ballots and a judge tossed it out. WTH? Good on you folks from Missouri.

The amendment also extends to ammunition, accessories. Some strong gun advocates were opposed to it because it has a reference to “ normal use”. Their concern was, who will define what is normal use?

I don’t think this amendment has any teeth.
Some judge will just cite the supremacy clause and say that federal law trumps Missouri’s constitution.

I’m glad to hear it, but still, good luck with that. Colorado has the “shall not ever be questioned” language in its state Constitution, but that hasn’t stopped universal background checks and mag capacity limitations and a whole bunch of other recallable-over legislation from being passed.

Fortunately, the recalls functioned properly. But we still have the laws on the books, although some sheriffs have stated they can’t, and anyway won’t, enforce it.

Your comment simply points out the need to start removing recalcitrant “judges” from the bench. There is a mechanism, but it is seldom employed. Judges who “make law” need to be taken out.

States can tell any Federal Judge to get lost. Your ruling has no force of law in this state. The Governor just says I work for the people of MO and they have spoken. We in MO do not work for a political hack on the federal bench. What are the feds to do? Send in the military that has been reduced to pre WWII levels? Send the BATFE where the Sheriff doesn’t authorize them to enter his county or enforce any law without his specific approval. Come on man....we (Read: People of the states) have got to just tell the feds to get screwed.

Those black-robes should be lamppost decorations. An effort that cost millions of dollars and millions more of human time and effort should not be removed at the whim of some black-robed pig.

The job of a judge is premised on precluding “self help”. IOW a judge is stabled to take decisions away from the parties and make them dependent on his/her/it decision.

While useful in normal situation, the antipathy judges have to the second amendment is based on their own fear of citizens making decisions without the need for judicial dependence.

Thus, there will be a judge who will make such a ruling because self determination is counter to the judicial world view.
