Aren’t they suing over Obama’s refusal to enforce the employer mandate? If they win, that provision gets put back in. That’s bad isn’t it?
I think the lawsuit is silly. I agree with Levin. A judge will say, “why do you want me to solve this problem for you? You have tools at your disposal to bring him to heel.”
Depends on your political calculation. The Employer Mandate will cause lots of people to lose their employer-purchased health insurance. If implemented according to the timetable established in the law, those unhappy people would be voting in the 2014 congressional elections.
