No, since we dont actually follow the Constitution and laws anymore.

Don't the rest of the states have to ratify this? No, but the California legislature and the U.S. Congress would both have to ratify it. (U.S. Constitution, Article IV, section 3).

I think California has to withdraw from the union first before it can reapply for statehood as six states — and that will require a civil war first.
