Supreme Court Rejects Appeal From Reporter Over Identity of Source

WASHINGTON — The Supreme Court on Monday turned down an appeal from James Risen, a New York Times reporter facing jail for refusing to identify a confidential source.

The court’s one-line order gave no reasons but effectively sided with the government in a confrontation between what prosecutors said is an imperative to secure evidence in a national security prosecution and what journalists said is an intolerable infringement of press freedom.

The case arose from a subpoena to Mr. Risen seeking information about his source for a chapter of his 2006 book “State of War.” Prosecutors say they need Mr. Risen’s testimony to prove that the source was Jeffrey Sterling, a former Central Intelligence Agency official.

The development of a Fascist State like Hitler had in 1930’s Germany, and what Obama almost has now in the nearly former USA, depends upon opposition leaders who refuse to lead the opposition, but continue to stay in power by support of their morally weak supporters.

The last attempt to oppose Obama failed when Boehner, Cantor, McConnell and McCain caved in to the stonewalling refusal to negotiate by Reid and Obama in late 2013 and early 2014.

Until effective voter pressure can be brought to bear on the Republicans and Democrats in the House and Senate to replace the Republican Leadership in the House and Senate, Obama will continue to “Fundamentally transform the United States of America” into the most powerful Fascist Empire that the World has ever known.

Will these opposition Congressmen and women act before the November 2014 Election, or will they continue to wait to lose again, as usual, to the Left Wing, low information Voter in November, 2014?

BTW, money and reason are wasted on multimillionaire career politicians as they cannot be bought or convinced - - - they are the hardened professional criminal politicians that we have, for decades, elected and tolerated, gratefully for the “free” stuff that they have bought our votes with.

Obama is just doing as he was raised up to do, and will never change.

Our opposition Republican Leaders are doing everything that they can to make sure Obama is successful, and they will never change.

The change must come from opposition House Members and Senators in “both” parties, before low-information voters have made up their minds about whether or not to continue the status quo.

The Summer of 2014 is the last chance for We, the People to force our House and Senate Members to change their leadership before Labor Day, 2014, when early voting begins?

No truer words spoken. And there is literally nothing in his way. Just a few useless committees, lots of talk, few real patriots in the Republican Party in Washington and that's about it. Don't forget the communists MSM. That one entity has caused more destruction than any radical in the world.

The New York Times has been a major cheerleader in promoting the theory that the 2nd Amendment doesn't really mean what it says.

And the 1st Amendment doesn't really mean what it says either when liberalism is established as the state religion and when the invented rights of the gay mafia to services from people of religion are concerned.

Can they really be surprised when the Freedom of the Press portion of the 1st Amendment is so easily discarded as well?

I find the irony delicious: Risen is a scumbag who worked with Dem moles in the security apparatus to sabotage as many of Bush's covert anti-terrorist ops as he could, helping to pave the way for Obama's election.

Now he will probably be jailed by Obama.

But Attorney General Eric H. Holder Jr. hinted last week that the Justice Department might choose not to ask the trial judge to jail Mr. Risen for contempt should he refuse to testify.

Now that the kangaroo court has rubber stamped what Holder wanted, I'm sure Risen feels all warm and fuzzy about the possibility that the King's Chief Legal Officer will show mercy.

It is beyond time for voting. We the people need to be able to sue and have these politicians removed immediately from office to be replaced by representatives that can and will carry out the will of their constituents.

The system we have now is being gamed by the professional politicians for their own benefit.

Generally, a denial of cert does not indicate how SCOTUS would rule in a particular case and no opinion should be inferred. Because SCOTUS won’t hear Risen’s appeal, Holder can (but likely won’t) jail Risen. That doesn’t actually mean that SCOTUS sided with the government, but the end result is that the government wins.

Actually, this is good news. Here is the case from 1972 that is pertinent. It says that reporters have to answer subpoenas just like every other citizen.

That case also says this:

The administration of a constitutional newsman's privilege [p704] would present practical and conceptual difficulties of a high order. Sooner or later, it would be necessary to define those categories of newsmen who qualified for the privilege, a questionable procedure in light of the traditional doctrine that liberty of the press is the right of the lonely pamphleteer who uses carbon paper or a mimeograph just as much as of the large metropolitan publisher who utilizes the latest photocomposition methods.

The efforts now underway to create a federal "shield law" would gut the first amendment. It would be a license to publish
