Secretary of Defense Chuck Hagel said the U.S. did not negotiate with terrorists in the process of exchanging the transfer of five terrorism suspects for the release of Sgt. Bowe Bergdahl. “We didn’t negotiate with terrorists,”

If we had "negotiated" we probably could have gotten the deserter for one terrorist instead of 5.

We just capitulated to their demands. We didn't offer a counter offer because that would have been "negotiations."

As long as you don't make a counter offer to the initial demand, there is no "negotiations." If we had offered to release 3 instead of five, that would have been illegal, since WE DON'T NEGOTIATE WITH TERROROSTS!
