Wow, totally believable. The FB account doesn’t mention any races, which was the right thing to do to get the story out. Think about it.

This kind of thing happened in my old neighborhood in long Beach, Ca not many years ago.

you know what wrench, even though I would never want to associate with someone who thinks like you, your post was 100% true regarding that blacks now can do anything they want and get away with it and if you dare stand up all govt will come down on you.

I mean in the same situation ghetto man grabs your wife’s a%$^ and the only recourse today is to look down meekly and apologize to the ghetto lords for not offering a better squeeze. I mean that 100% too. Cause if you stand up, well then we’re back to square one of not “avoiding” the situation or fanning the flames.

"That male [Savannah tribe]" for some reason, could not restrain himself, even when additionally-restrained by his male companion [Savannah tribe] who had initially gone around the "cluster of families" [Atlanta tribe].

Meanwhile among the "cluster of family members [Atlanta tribe]," one *its own* 2 adult males could not apparently restrain himself from expressing some opinion [police report: "one of the males in the Atlanta family continued to talk"].

Upon which, "that fellow [Savannah tribe]" who had first walked thru the "cluster of family members [Atlanta tribe]" ... and though being himself restrained by the "other male [Savannah tribe]" who had initially walked around the "cluster of family members [Atlanta tribe]" ... proceeded to assault one [presume-ably he who "continued to talk"] of the 2 males of the "cluster of family members [Atlanta tribe]".

The previous 30 sec of video would help, but looks like things were over and the (soon to be) victim kept running his mouth, while holding his little girl in harm’s way .

I don’t see this turning out real well. I could even see “charges” brought against those whom were attacked physically. Looking at some of those posting on the area sites, I don’t hold out much hope for, “can’t we all get along”?

IMHO, the last to avoid the “fight” was the guy in red who ran back and physically started (IMHO by straining to look at the vid) the fight. He had the last chance to avoid a physical alteration. Whomever was “rude”, does being “rude” now deserve a “beatdown” or instead of walking away from rude behavior of any kind, a physical beatdown is justified?

I hope our society hasn’t gotten to the point of lack of restraint and physical attacks are deemed appropriate and lawful. (I’m talking about if someone says something someone doesn’t like or takes offense to, they (the offended party) has the RIGHT to go kick the crap out of someone even to the point of DEATH)

Maybe this is a “guy thing”, but in the pics that the PD put out (posted in the 50-100 comments), the guy in red has taken his shirt off and is in a white tank. When guys fight, or after they fight, do they automatically take off their shirt?

countdown until “the One” is asked about the “stupidity” of the family from Atlanta at a presser, 3, 2, 1....

Thank you for the 2006 thread link. I wonder how those young ladies are fairing today? I’ll bet today’s media, hasn’t bothered to ever do an update on their condition. The injury description is horrible and no doubt led to a lifetime of taking anti-seizure meds for the head trauma and hopefully none were left blinded.

I assume the thugs have already been released from prison (presuming they were convicted and sentenced)

An experienced fighter, yes. Big loose shirt pulled up over your head by an attacker turns it into a straight jacket for a bit. Long enough to get hurt, bad.

The Atlanta family may be ‘sorry’ for posting on FB. The WTOC-TV posted an update (not sure where they obtained this info) that: “The man who said his family was attacked never called police to report the incident.”

I can safely assume, other than 911, the man would not have the non-emergency police number. BUT, I’d like to know if he did or did not call 911 or did he not because others already had? If that is the reason, the fact that he did NOT call 911 doesn’t mean squat, or “guilt”.

Not if the jury followed the jury instructions. There is a bright line on use of physical means. Under the law, you can "dis" somebody, call them all sorts of horrible names, and they have NO right to so much as give you a shove. Words alone are NOT escalation, under any criminal statute.

I do agree with your advice to just move on - I disagree with the suggestion to offer an "excuse me." But that said, deciding to gripe to the offender, even to insult them with all your might, that does not amount to sufficient escalation, under the law, to make you criminally culpable. There are plenty of cases on the books that illustrate this. The first one to use force, THAT person started it.

When I saw the video, I saw escalation from the vic;s side, and how I would vote on a jury.

“Fighting words” have meaning in law, but I am not a lawyer, so can not articulate the point.

If i call someone “penis breath” or worse in front of his family, I believe I have little recourse if I get popped in the mouth. Spit in his face at the same time guarantees it, but I guess that is assault.

Starting a fight is easy, holding civilization together takes work.

I see a “beer summit” coming soon. All joking aside, this isn’t going to go anywhere legally, but it is a good reminder to always know where you are and your surroundings. Certainly there has to be a better camera angle from another business? Those three guys in the front of the video, the one that touched the guy in red as he was running back, seem to have had a front row seat to some of what was going on. I wonder if we will hear from them?

You believe wrong. You have a rock solid civil suit for battery. There is NO justification for use of force, except in self defense against another's use of force.

"Fighting words" do NOT justify the use of force by your opponent, that's how the law reads. However, if you accompany your "fighting words" with a gesture that is reasonably taken as impending use of force, your opponent may use force to defend against your attack. The notion of "reasonable" is up to the jury, not you, but it has to be a reasonable belief that physical force is coming your way.

The jury instruction will make the definition of "aggressor" clear - that is the first person to use force. Verbal escalation simply doesn't count under the law. Everything hinges on physical escalation, who is the first to use force?
