Nebraska Moves to Nullify Unconstitutional Obama Gun Laws

Nebraska has now joined states like Florida, Arizona, Idaho, Missouri, Kansas, and Alaska in standing up for the Second Amendment -- and telling Barack Obama what he can do with his unconstitutional gun bans and gun registration schemes.

L.B. 1030 would prohibit any Nebraska state or local official from "restrict[ing] the carrying, possession, transfer, purchase, sale, or ownership of or otherwise regulat[ing] any firearm, ammunition, or component of any firearm or ammunition to a greater extent than state law."

This is particularly important in view of the Obama administration's efforts to ban and register guns unlawfully, by executive fiat.

Hence, Obama and his minions have recently tried to illegally ban imported shotguns because, supposedly, shotguns don't have a "sporting purpose." That would be nullified under L.B. 1030.

Obama is setting the stage, unlawfully, to strip guns from seniors with Alzheimer's, police with post-traumatic stress disorder, and people who, as kids, were diagnosed with Attention Deficit and Hyperactivity Disorder. Again, L.B. 1030 would tell Obama to take his illegal unconstitutional actions and stuff it.

Everywhere where states like Nebraska have stood up to Obama, there have been gun-hating liberals who have claimed that states are nothing but vassals in the federal system. They sometimes cite the San Francisco-based Ninth Circuit Court of Appeals, which has been reprimanded by the Supreme Court more frequently than any other bench.

But the fact is that the Supreme Court, in the 1997 Printz case, made it unambiguously clear that states cannot be forced to implement a federal regulatory scheme -- including a gun ban. Printz specifically held that states are not compelled to enforce the Brady Law if they do not choose to do so.

Sadly, it is a sociological phenomenon that some prisoners become so dependent on their prison cells that are afraid to live as free men. This is one aspect of the "Stockholm Syndrome."

But we hope Nebraska will choose freedom over subservience. We guarantee that freedom is a good thing, and you will come to like it.

Just let the Attorney Generals of States refuse to comply. Holder said it was O:K to pick and choose.

That’s right. Of course States Atty General have always had that option. But in the case of Holder I imagine it is a veiled threat.
