He Thought He Could Scare Good Samaritan Away by Lifting His Shirt to Reveal His Gun

An off-duty officer with the Houston Police Department fatally shot a robbery suspect outside a convenience store on Sunday night. The veteran cop was coming to the rescue of a man who was jumped and beaten by two men as he was leaving the store with groceries.

The officer, identified as 22-year Houston Police Department veteran C. Rodriguez, told investigators he noticed two men hiding behind a dumpster outside of the store, arousing his suspicion. He then saw the men jump out and start beating the victim.

Police say Rodriguez rolled down his window and ordered the suspects to stop. It wasn’t entirely clear if the officer already had his gun drawn.

Rather than complying, one of the suspects reportedly lifted up his shirt to show the cop his own gun and started walking towards him in a threatening manner.

That is because the off duty cop was acting in the same capacity as a private citizen. Under the law a cop is not required to try and stop those thugs from beating you, only to arrest them afterwards. His actions were no different than if any other armed good samaritan had intervened although he will likely recieve less scrutiny from the DA.

I think "flashing" is dumb period. The first indication a criminal will ever have that I am carrying is when he sees the fire coming out of the barrel. If a bad guy knows you carry they are more likely to ambush you and shoot you in the back or beat you to the draw.

I am fine with what the cop did. But I wonder if I shot a 17 year-old from inside my car if I wouldn’t be sitting in jail right now. Especially had the guy not drawn his gun.

I of course am thinking about the hell George Zimmerman went through after shooting someone who was beating his head in.

Dead guy was Oscar Gaspar, probably Hispanic. Just a different “bin” on the trash truck. When the perps are not white, there is seldom a picture in the article.

The comment someone posted to the story shows some degree of naivety.

“I think what happened here is sad, I think it’s worth mourning over that this kid was so brainwashed that he resorted to violence against another person.”

Brainwashed? That’s a good excuse for violent robbery.

In Texas, you just have to be in fear of your life. If he's flashing and walking towards you, you don't have to wait for him to draw down on you and say "Hey, I'm going to shoot you!". That's implied.

If the kid didn't show his gun and was walking over to you, he may have been just wanting to find out what you said if he didn't hear you. How frightening would that be? The gun flash was the threat and the cop neutralized it.

No bill.
