The states have never amended the Constitution to expressly protect so-called gay rights, such "rights" now being established by pro-gay activist judges who are wrongly legislating such rights from the bench. Otherwise, the states are free to make laws which discriminate against gay "rights," as long as such laws don't also unreasonably abridge constitutionally enumerated rights.

So what Ms Clinton actually needs to do advance her pro-gay agenda within the framework of the Constitution is the following. Clinton must work with state and federal lawmakers to propose a gay rights amendment to the states for ratification. And if the Article V supermajority of states choose to ratify such an amendment, then gay rights will be constitutionally protected and Clinton will be a hero. (Note that I don't believe that Clinton will get the necessary support from the states for such an amendment.)
