The insurance company is probably doing the suing. That is one of the first questions they ask when you are injured, “how and where did this happen?” They have to assign blame so they know who to sue.

People will sue for anything.

I'll withhold judgement on the guy. It might be necessary in order to get an insurance company to pay. On the other hand, he might be a total butt.
