The form asks if you are an unlawful user of marijuana. If one smoked pot in the past but does not currently consume it, one can fill the form out properly without lying. I would be interested to see what case law is out there defining what constitutes a “user.” Perhaps the gun buyer stopped smoking that week, and then decided to pick it back up a week later. I wouldn’t want to be the test case but it appears the feds left it ambiguous.
