Unions Get Big ObamaCare Christmas Present As Other Self-Insured Groups

Welcome to the new world of ObamaCare reality.

As a presumed constitutional scholar, Barack Obama should know that while a president has authority to check the Legislative Branch by recommending legislation to be passed by Congress, or through presidential veto, he or she cannot legislate through executive fiat or pick which parts of the law to comply with or decline. Article 2, Section 3, Clause 5 of our Constitution requires that the president “…shall take care that the Laws be carefully executed.”    It doesn’t limit those laws or encapsulated provisions to the particular ones that he or she likes.

Speaking before the House Judiciary Committee on December 3, Professor Jonathan Turley of George Washington University observed that the president isn’t taking that “Laws be faithfully executed” oath very seriously, particularly with regard to his signature Affordable Care Act (aka.“ObamaCare”).

Although Turley had voted for Obama and professes to agree with him on health care and other issues, he warned that his power grabs are causing “the most serious constitutional crisis in my lifetime.”

The White House Earns Its Union Label

In addition to delaying and rewriting key ACA provisions and carving out a special subsidy for members of Congress, Obama’s latest constitutional violation will exempt unions from a fee the law imposes upon all large group health plans. That provision which appears in Section 1341 (b)(1)(A)  establishes a reinsurance program to compensate insurers on exchanges in the individual market if they are hit with higher than expected costs to cover those with pre-existing conditions. This will come from insurers and self-insured employers who pay in proportion to the number of people they cover. The target is to raise $25 billion during 2014, amounting to $63 per covered employee. The union exemption would kick in for 2015 and 2016.

You have to have standing. And now that Obama has stacked the DC Court (which hears legislative appeals) with three new liberal judges, it’s unlikely he can even be touched - plain and simple, legalized tyranny ...

Obama is a Progressive Constitutional Scholar. That means that he knows which parts of the Constitution he’d change if he was the dictator of America.

Fortunately, for most Progressive Constitutional Scholars, this is just mental masturbation.

Unfortunately, this particular one rose to the top and didn’t get skimmed off as scum usually does.

He knows he’s violating the Constitution and he knows that no one in Congress or the courts will do anything about it.

The soap box, ballot box, and jury box have failed.

Any Senator or Representative should have it.

But you are right, when you own the courts not much can be done.

I hope Roberts burns in hell (sorry, but generations of Americans — starting with this one — will be suffering under the yoke of obozocare and it was his tortured “logic” that created that suffering).

Take heart! There are TONS of court cases working their way through. And why do we not hear of this you ask? Ask the lapdogs in the MSM.

When 2/3rds of the states refuse to sign up - that is a huge red flag - Obamacare is in real trouble.

Forget the fact that they produced an incomprehensible website.

Only 14 states are actively working to set up exchanges.

Obamacare is already dead before it really got going.

One more thing - there is no way Obama can recoup the trust he lost because he lied to everybody.

It isn’t time for that yet. People still have food and comfortable lives, 75% have jobs and the rest have handouts. Most Americans still think of Tim McVeigh and the Unabomber as villains instead of visionaries. It has to get a lot worse before the ammo box is a viable solution.

After seeing Kosovo and other places that went to the ammo box in recent history, I think that most sane people would rather live in France or Greece than Bosnia. But the overreaches of the government are pushing us to the insanity of armed rebellion—especially with the way they try to quash civil disobedience, which should be celebrated as a relief valve for an unhappy populace.

I read about this exemption during Thanksgiving. (Of course, they dumped the news release right before the holiday.) Why are we not hearing about it on any news programs? I consider it one of the most egregious acts so far.

Some reporter could do a very popular story if he'd check out the kind of health insurance union members enjoy. I understand most plans are extremely generous, with coverage for vision, dental, hearing etc. Many get to stay on their plan when they retire early. Retire at age49,52, 56, and stay on the health insurance till Medicare age. Pretty nice! Would also love for the report to include how much union members contribute to their premium (compared to how much workers in private sector contribute).

I am outraged that those with the most generous CADILLAC PLANS will pay no tax, while everyone else must pay! In fact, this "ruling" made sure the revenue line wouldn't suffer. It increased the amount each person pays, so as to make up for unions not paying anything!

For months, the media reported on the unions campaign to get this exemption! Yet, when they actually got it, NOT ONE outlet reported it, not even FOX NEWS!
