PHIL, CALL YOUR LAWYER Under Obamacare, the Taliban gets an exemption for religious reasons.

REFERENCE On page 107 of the Obamacare legislation provides for individual religious exemptions. The language is non- specific with regard to particular faiths, however. Read carefully:

(5) EXEMPTIONS FROM INDIVIDUAL RESPONSIBILITY REQUIREMENTS.— In the case of an individual who is seeking an exemption certificate under section 1311(d)(4)(H) from any requirement or penalty imposed by section 5000A, the following information [is required]:

(A) In the case of an individual seeking exemption based on the individual’s status as a member of an exempt religious sect or division, as a member of a health care sharing ministry, as an Indian, or as an individual eligible for a hardship exemption, such information as the Secretary shall prescribe. Similarly, page 128 of the legislation states:

“(A) RELIGIOUS CONSCIENCE EXEMPTION.—Such term [i.e., “applicable individual”] shall not include any individual for any month if such individual has in effect an exemption under section 1311(d)(4)(H) of the Patient Protection and Affordable Care Act which certifies that such individual is a member of a recognized religious sect or division thereof described in section 1402(g)(1) and an adherent of established tenets or teachings of such sect or division as described in such section. The above passage amends the Internal Revenue Code of 1986, of which Section 1402(g)(1) defines “a member of a recognized religious sect or division thereof” as follows:

(1) Exemption Any individual may file an application (in such form and manner, and with such official, as may be prescribed by regulations under this chapter) for an exemption from the tax imposed by this chapter if he is a member of a recognized religious sect or division thereof and is an adherent of established tenets or teachings of such sect or division by reason of which he is conscientiously opposed to acceptance of the benefits of any private or public insurance which makes payments in the event of death, disability, old-age, or retirement or makes payments toward the cost of, or provides services for, medical care (including the benefits of any insurance system established by the Social Security Act). Such exemption may be granted only if the application contains or is accompanied by—

(A) such evidence of such individual’s membership in, and adherence to the tenets or teachings of, the sect or division thereof as the Secretary may require for purposes of determining such individual’s compliance with the preceding sentence, and

(B) his waiver of all benefits and other payments under titles II and XVIII of the Social Security Act on the basis of his wages and self-employment income as well as all such benefits and other payments to him on the basis of the wages and self- employment income of any other person, and only if the Commissioner of Social Security finds that—

(C) such sect or division thereof has the established tenets or teachings referred to in the preceding sentence,

(D) it is the practice, and has been for a period of time which he deems to be substantial, for members of such sect or division thereof to make provision for their dependent members which in his judgment is reasonable in view of their general level of living, and

(E) such sect or division thereof has been in existence at all times since December 31, 1950.

THIS WE KNOW Islam considers insurance to be “gambling”, “risk-taking”, and “usury” and is thus banned. Obamacare exempts Muslims specifically based on their religious beliefs.

Is anyone else exempted from O/Care by reason of religious affiliation? They are IF you can you find a religious group that is against public health insurance, and had enough people join by 1950 to create an exemption.

If a few million Christian conservatives canceled their cable and satellite services in response, the TV media would certainly take notice. Every one of these Left wing megaphones should fear that type of scorched earth backlash, our families would be far better off without the pollution that flows from the media sewers, and we could save $100 every month in the new year. We don’t need pervert-promoting TV.

We want to thank all of you for your prayers and support. The family has spent much time in prayer since learning of A&E’s decision. We want you to know that first and foremost we are a family rooted in our faith in God and our belief that the Bible is His word. While some of Phil’s unfiltered comments to the reporter were coarse, his beliefs are grounded in the teachings of the Bible. Phil is a Godly man who follows what the Bible says are the greatest commandments: “Love the Lord your God with all your heart” and “Love your neighbor as yourself.” Phil would never incite or encourage hate.We are disappointed that Phil has been placed on hiatus for expressing his faith, which is his constitutionally protected right.We have had a successful working relationship with A&E but, as a family, we cannot imagine the show going forward without our patriarch at the helm. We are in discussions with A&E to see what that means for the future of Duck Dynasty. Again, thank you for your continued support of our family.

Well, then, the catamites will get a check from you every month, whether or not you watch their swill.

Perhaps in the future the channel bundling system won't exist, but to get there, we first need to break the back of the existing system.

Besides, Cable TV is a timesink, just think of the better things one can do with that time!

Reality TV contracts do not favor the participants in the show. Most have morals clauses that can be exercised on a whim, similar to those used in professional sports contracts.

It’s highly unlikely there will be a contractual provision that favors any of the Duck Dynasty crew.

The author’s point is valid. If speaking out against homosexuality is what it takes for A&E to pull the plug, the rest of the family may want to go on Rush Limbaugh or a Sarah Palin Fox TV special and discuss their views on the issue as well as their Christian faith.

The show would be picked up by another network quickly if the Robertsons want to proceed under different terms.

And this is why we need an open-minded Supreme Court (certainly not this one!) that will extend First Amendment protections to *private* employer-employee relationships. And, remember, Phil Robertson wasn’t even on the job (unlike, say, Martin Bashir) when he said what he said. So long as someone is doing their job, they should NOT be fired for what they say off the clock, so long as it isn’t libelous or violates national security. Just common sense. Just relying on the “free market” won’t work in cases like this, because businesses often take the coward’s way out.

Have no idea how the Robertson’s contract reads, but if they can, refuse to do any more shows with A&E. Another cable outlet will pick them up. The problem will be getting linquini spined sponsors. Notice how the perverts have no trouble getting sponsors. What an upside down world....evil is now good......good is now evil!

The answer is not going after the cable providers, instead focus on the advertisers. You see that Under Armor and some others have already voiced their support of Phil’s right to say what he did. Under Armor was a little wimpish about it saying they don’t agree but this whole mess is muddled up in just one paragraph of a three paragraph answer. The last paragraph summed it all up in that nobody could disagree with.

Essentially he said it was not his job to judge a person’s direction of travel in the afterlife and that rested entirely with God himself to determine. He was just telling the interviewer what is said in the Bible and he agreed with it and it was his position to be enlightening those who have never read the Bible or refused to live their lives by it.

I think thy also need to maintain Phil’s focus on homosexuality as one of numerous sins which may tempt any of us. As a sinner He puts himself in the same basket as gays and a host of others when he admits to repeated adulterous indiscretions. He says he understands his own temptations but not others, but he doesn’t say his past actions are any less depraved than sodomites.
