This is a video of a citizen resisting a DUI checkpoint. I don't know the local law, but I am sure the local law support the practice of these checkpoints. However IMHO they are clearly a violation of the 4th amendment as written. Clearly one of the Police Officers easily lied (routine policy) and stated that he smelled alcohol in the car.

My point in posting this is to show how easy it is for a Police officer to manufacture probable cause.

The officer asks "you do want us out protecting you don't you?" The citizen does not answer. I will. No officer, it's not worth the price.

Police routinely manufacture probable cause. They can claim they smell something, or even use every officers favorite, the furtive look.

You can get a DUI for being asleep in your PARKED car with the keys in the ignition. Even though you may not have actually driven drunk, they’ll bust you anyway. It is a racket.
