Impeachment Lessons
National Review Online ^ | 12-7-2013 | Andrew C. McCarthy

Well whaddya know: The topic of impeachment reared its head at a House Judiciary Committee hearing on Tuesday.

Jonathan Strong’s report here at NRO noted the wincing consternation of GOP-leadership aides at utterances of the “i-word” during the testimony of prominent legal experts. For the Republican establishment, it seems, history begins and ends in the 1990s: No matter how times have perilously changed, any talk of shutdowns or impeachment is bad, bad, bad. Yes, the Obama “uber-presidency,” as left-of-center law professor Jonathan Turley called it, has enveloped the nation in what he conceded is “the most serious constitutional crisis . . . of my lifetime,” but GOP strategists would just as soon have us chattering about immigration “reform” and bravely balancing the federal budget by, oh, around 2040.

But as we discussed in this August column — back when the first anniversary of the Benghazi massacre loomed, back when many Americans still believed that if they liked their health-insurance plans, they could keep their health-insurance plans — it is not crazy to talk about impeaching President Obama. And if you’re going to have a congressional hearing about systematic presidential lawlessness, it is only natural that the word “impeachment” gets bandied about. Not only is impeachment the intended constitutional remedy for systematic presidential lawlessness; it is, practically speaking, the only remedy.

If McCarthy is talking about this, it has hit the mainstream, big time.

The only time I will believe any of their idea of impeachment is when I see it with my own eyes. Too many lies coming from the gubmint and the people doing the “talking” ARE in the gubmint.

I would not be surprised if odumbo has a major list of items he will use against the repubs should they even consider impeachment.

Finally!” He has been woefully derelict in his duty “

I hope more begin to tell the truth! I am so tired of things like ‘leadership deficit’ and teeny-tiny, fearful, pokes at the truth and reality of the situation.

yes good article indeed. In just two pages it lays out how we got here and the possibilities going forward.

In order to fundamentally transform us into a socialist/marxist state; power must be consolidated and the constitution must be run over.

The constitution has two methods built in that would allow Congress to prevent/stop such consolidation of power to the executive - power of the purse and impeachment.

A few years ago, dems began doing continuing resolutions instead of the normal budget process of individual funding bills. Big mistake - that effectively removed from the House the power of the purse. House is no longer able to just defund something b/c it’s in an “all or nothing” bill to fund the government... and repubs get the blame now for shutting the government. So the only remaining remedy is impeachment. That’s a non-starter.

So, we have the usurper for 3 more years. That’s the end of the article.

Principled believes that a majority kept in the House and a Majority [or even near majority] won in the Senate is the best shot notwithstanding the courts overturning 0bamacare before elections in Nov 14. If 0bamacare is repealed, it will effectively hand the Rs a functional majority.

If we keep majority in the house, we still wield the power of the purse. If we win a majority in the Senate, we can revert to individual funding bills as our budgeting process. This would remove the political hardship from the Rs in a defunding battle b/c 0bama would have to veto the funding [instead of just being able to not even vote in Senate.] Even with a 49-51 minority there will likely be a few Dems that will go against 0bama... I’m not sure how the new nuclear option may fit in. Maybe not good, maybe good.

In any event I am optimistic right now that the Dems are completely freaking imploding.

Thus the quasi-legal component — proving high crimes and misdemeanors — is the easy part. As a practical matter, fundamental transformation cannot occur without high crimes and misdemeanors being committed against the constitutional order that is being transformed. That’s the whole point.

Emphasis.

‘odumbo has a major list of items he will use against the repubs ‘

It is time for the CongressCritters to finally learn the constitutional lesson of what it means to be a, Co-Equal branch, of the US Government.

Impeachment may seem to be an extreme step to take, but the Founding Fathers included it in the Constitution for one simple reason. To allow for a course of action to be taken against a rogue president who has deserted the prinicpals that have served this country well for over 200 years. The only alternative being armed conflict.

If the senate is taken by the repubs in 2014, then impeachment needs to be the first item of business for the new congress.

At this point in time we do need transformative change in the oval office.
