None of Obama’s executive order tweaks to the Obamacare disaster are constitutional. I can’t imagine any legal advisors to insurance companies saying it will be OK to violate federal law just because Obama says they can do this. State insurance commissions will also have to sign off and I can imagine they too will have problems with Obama’s unconstitutional diktats.
It was written into the Act that nobody read that the HHS has the authority to stipulate the regulations. It was written into the legislation that the Dim Congress approved late night Christmas. So yes, Obambi HAS the authority to change some of the rules through administrative actions.
It's there. Read it. I've seen the Congressionally approved clauses that gives the Executive Branch the power to change certain things. We're just plain screwed.

The legal authority to do what, exactly? That part wasn’t really all that clear. He could issue an executive order to simply not enforce provisions of the law for one year. Under that scenario he would simply be asking insurers to sell illegal policies, on the promise that he won’t penalize them for doing so. Anyone else see the potential for lots of private litigation? There’s no way a company should be willing to take that sort of risk, assuming state insurance commissioners would go for it in the first place.
I heard him kind of mention prior to Obama’s presser today. But, I have heard nothing since. They have to stand up and stop allowing Obama to act lawlessly.
