Actually, if you can blame it on a bad business decision then prosecution is unlikely. The law allows you to be an idiot. They’d have to prove that he committed fraud. In politics you’re actually allowed to lie to voters. But if we lie to Congress, we go to prison.

Much as I’d like to see this man in prison there’s the possibility that, like Hitler’s trial, it will make him a martyr. It is better to use the impetus, assuming there is one, to erase all that he and 60 years or so of socialism have done.

But you can't lie to donors, either, or else you are defrauding them by taking their money for false purposes.

If Obama took campaign funds from solicitations that specifically referenced "keep your plans and doctors if you like them," then he knowingly lied to take money from unsuspecting donors who are now being harmed by his lies.
