The 2013 Battle of Yorktown -- restaurant owner defies feds

“I am now occupying the building at this time.”

And with that one decision – restaurant owner Glenn Helseth joined the ranks of Americans who’ve decided to defy the strong-arm tactics of the National Park Service.

For the past 11 years Helseth and his wife have operated the Carrot Tree Kitchens Restaurant inside the historic Cole Digges House in Yorktown, Va.

At least 20 of Helseth's longtime employees are facing unemployment. They can’t make rent and some are faced with choosing between buying food or buying medicine.

The National Park Service owns and operates the building. So when the government shut down on Oct. 1, the Helseths were given 48 hours to pack up and move out.

The couple also owns a restaurant on Jamestown Island. They had to close that restaurant after the National Park Service blocked access to the island.

Marxists and communists regularly kill their own for political advantages, if any are to be gained.

Precisely--they are still wearing t-shirts with Che on them. It's even better if they can blame the opposition for the hit. That's a two-fer.

Watch for some deranged caucasian with a 'history' to pop up as patsy.

Whatever background he/she needs will be pumped into official records...and discovered... and they will try to use his/her actions to disarm us all.

Don't bury them, it's almost time to dig them up!

Then either do away with the rangers altogether or retask the satellites to something useful and give the rangers a pair of binoculars and a watchtower. Turn them back into Smokey the Bears instead of brownshirt wannabes.

The constitution only gives the federal government authority over District of Columbia and places such as forts, magazines, arsenals, dockyards and other needful buildings.

However, the Second Paragraph of Section 3, Article IV of the US Constitution states in part: “The Congress shall have Power to dispose of and make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States;”

At the time, that was mostly the Northwest Territory, but later other Territories came to belong to the United States. An interesting question is: By what Constitutional authority did those other Territories come to belong to the United States?

In the case of many (not all) states beyond the first thirteen, said states were formed from the territories which were owned by the United States. Not the United States Federal Government, the United States.

Bearing that in mind, in many cases all of the territory/land/property within the bounds of a newly formed state was not granted to the State upon it’s Statehood. Some was retained by the United States.

I don't see where this law says that the Executive branch nor the director of the US National Park Service is given this authority.

If they have that authority I suppose it would stem from the “needful Rules and Regulations” Congress has the power to make.

I don't know how many times I have made that same argument.
The National Forests, National Parks, National Monuments, BLM Lands, any thing that the government is claiming to maintain (and failing at)actually belongs to WE THE PEOPLE. We bought it, We paid for it, We pay for the maintenance on it, We pay the salaries for the bureaucrats that are supposedly there to serve us when we visit. The government does not own these lands or monuments or parks. WE THE PEOPLE DO. In my opinion the only thing the government is entitled to restrict entrance to is federal office buildings and military bases.
It is beyond me why most people can not understand this.

Then why the heck do we have to pay/get passes to get into them? and why are they asking for donations on their website(s)? Why are any of these places closed? Haven’t the $$$ been set aside...or was it for this very point in time that the Dems were anticipating when they put off passing ANY budget over these last several years? Leverage?

Yes, they do. The proud jackboots boast about how anyone and everyone has to answer them no matter what they ask you — because THEY are federal agents. Disobey and you are Tazed or put in a holding cell (yes, some national parks have their own jails).

The issues with the Rangers could be easily handled if there were any brave sheriffs around. See.....

Okay, no offense intended, but this phrase being tossed about by people is starting to make my blood boil. Exactly what would they do under martial law that they are not doing already?

(NOTE: check out Eric Cantor's OP-ED in the Washington Post on the subject of an administration out of control)

This article shows us that in many cases, a revolt is underway. Another is looking at how many people are NOT signing up for ACA. Frankly, it is well pass the time for sitting around complaining and at the least - time for open and massive civil disobedience.

I predict that the longer this standoff occurs, it will only be a matter of time before some park ranger or other gov thug opens fire on and unarmed citizen. With that said, there is no one person who will give the signal for us to take counter actions. That signal will be up to the individual. In short, when will each of us say 'Enough is enough?'

I'll close with this: Even if there is a peaceful means to do away with this current administration, I believe a few thousands of us may be killed before that happens. If non-peaceful? Well, you do the math.

24 hour curfews, weapon confiscation, jail, suspension of elections and of trials, habeus corpus goes bye bye, control of food, water, electricity and utilities.

And all of that and more is in place. That said, I think you are right - it is time.

If you think not "owning" an entity would stop them from taking any action they desired, you're fooling yourself. If they wanted the power cut off, they could do so in a heartbeat.

Well it would be insane. But they did it on purpose, to shut him down! So it was not insane; but done with intention, desiring to hurt real people! The owner is the one worrying about his employees’ welfare; — the workers afterall! SO: Which is the Party of Compassion? Unless you own property and employ people — then you are a threat to the State?!? And YOUR employees mean nothing to the State?!? How absurd! So back to your point, it has to be insane, except that they intended it! HOW COOL though, for the small business guy to come across as more concerned about the workers — whom he considers and KNOWS as to be real people — than the minions of some statist power, that would shut him down despite the hardships on real workers, real employees. Well we know who the heros are, and it is not the State, who would sacrifice real workers to harm in order to harm the real employers who actual CARE about the people who are their employees! On a personal level! With REAL not pretended compassion. Obama, you are outed!
