You may not like it, but if the Scotus already decided that Obamacare is constitutional, where else can one appeal to? The way it is now, only Congress can repeal it.

Paudio, given the remote possibility that you aren't aware of the Founding States' division of federal and state government powers, please consider the followig. The federal government has only those limited powers which the states have expressly delegated to Congress via the Constitution, and healthcare isn't one of them.

In fact, regarding the so-called constitutionality of FEDERAL Obamacare, are you aware that, regardless what activist justices want everybody to think about the constitutionality of Obamacare, the Supreme Court had previously officially clarified that the states have never delegated to Congress, via the Constitution, the specific power to regulate, tax and spend for public health purposes?

"State inspection laws, health laws, and laws for regulating the internal commerce of a State, and those which respect turnpike roads, ferries, &c. are not within the power granted to Congress. (emphases added)" --Gibbons v. Ogden, 1824.

"Congress is not empowered to tax for those purposes which are within the exclusive province of the States." --Justice John Marshall, Gibbons v. Ogden, 1824.

"Inspection laws, quarantine laws, health laws of every description (emphasis added), as well as laws for regulating the internal commerce of a state and those which respect turnpike roads, ferries, &c., are component parts of this mass." --Justice Barbour, New York v. Miln, 1837.

“Direct control of medical practice in the states is obviously (emphasis added) beyond the power of Congress.” –Linder v. United States, 1925.

Also, note that Congress ignored that Judge Andrew Napolitano had read Congress's constitutional Section 8, Article I limited powers before Congress voted on Obamacare, the judge not finding the power to regulate healthcare in Section 8.
Judge Napolitano & the Constitution

Finally, corrupt Congress ignored a resolution to petition the states to ratify a healthcare amendment to the Constitution both before and after Congress passed Obamacare.

“Proposing an amendment to the Constitution of the United States regarding the right of citizens of the United States to health care of equal high quality.” --H. J. Res. 30

So do you see why I'm a little bit upset with the corrupt federal government concerning constitutionally indefensible Obamacare?

I’m from Scranton, and I ripped into his office twice this past week. Better late than never, though. *Thank you, Pat Toomey!* He was extremely eloquent on the Sue Henry Show this morning in defense of his vote. Bob

Toomey has a ways to go before he gets me back, but this is a good start.

I see why you’re upset. But, saying Ted Cruz doesn’t understand the constitution when he has shown he does and put himself out there just doesn’t make sense to me. But I see that you’re more inclined to blame and tell others that nobody understands constitution as you do, rather than offering a real solution beyond repeating the same thing. Again, simce the Scotus already decided 0bamacare is constitutional and it depends on Congress—which as for now doesn’t want to act, what other venue that Cruz or other can go?

>> Cut the crap, Enzi is one of the democrats best friends, the author of taxing the internet bill as his signature example of being conservative, the best friend of Harry Reid who will never fight for a conservative cause. The typical go along to get along Senator. He did this opposed to his normal crap in order to NOT get primaried, and for no other reason. He needs to leave. <<

Yeah, yeah, yeah, pay no attention to actual voting record, Enzi is a horrible evil RINO scum who is worse than Arlen Specter. He is obviously the worst Republican in the Senate right now and MUST be defeated by someone immediately. We're not going to mention who that someone is because we don't want to have to discuss her values and qualifications, but it will be an upgrade if we get that someone in, and it doesn't matter if that someone was never pro-life prior to running for the Senate, and is considerably to the left of Enzi on gay rights and illegal alien amnesty. The MOST important issue is Enzi MUST go, and even if he wasn't a RINO, three terms is NEVER acceptable under ANY circumstances.

Yawn.

Sorry, Liz Cheney fans, nobody's drinking the kool-aid.

Oh, so he's NOT the author of the internet taxation bill, right?

And he's been really, really effective......right?

And he claims to be one of Harry Reid's best friends, it's been his ability to work with them that Enzi values....

The only reason he voted for this was the same reason Juan McCain became for the border fence when he was reelected.

Sorry, dude's a fake, flame all you want, we don't need back benchers who have no fight in them when it counts.

But, saying Ted Cruz doesn’t understand the constitution when he has shown he does and put himself out there just doesn’t make sense to me.

With all due respet to Sen. Cruz, how many times could Cruz have read the historical material concerning no federal authority to regulate public healthcare that I referenced in my previous post during his recent hours-long filibuster? And if he had some time to spare (ahem), he could have thrown in James Madison's Federalist No. 58.

In Federalist No. 58 Madison had noted that the Founding States uniquely gave the HoR the power of the purse as a tool to prevent federal government abuse of power as has happened with Obamacare.

In fact, House RINOs at least read the Constitution aloud after they regained majority control of the House in the 2010 elections.

Harvard Law School-indoctrinated graduate Cruz instead makes his big splash by reading Green Eggs and Ham. If he had read the Constitution-related materials on the other hand, it might have been his daughter's first exposure to the idea of the federal government's constitutionally limited powers. (Are we having fun yet?)

Note that I will support Cruz for president if Obama guard dog Fx News selects Cruz as Republican nominee for president. (Yes, I know that's not how the process is supposed to work, but ...)

If Enzi is a fake, Liz Cheney is off the charts. There’s a reason the RINO political establishment wants her and her radical pro-gay agenda in DC instead of Enzi and are trying to shove this lifelong Virginia(!) resident down the throats of Wyoming Republicans.

The old GOP died when Romney lost in 2012.

We are just now finally casting off the dead weight of the old GOP.

Their lingering stench was decreased a lot this week by nice cool breezes coming out of TEXAS and Utah.

He’s a fake, he’s a place setter, a bore that’s never actually done anything other than watch the democrats win. The idea that the “establishment” wants her is laughable. Enjoy: http://legalinsurrection.com/2013/07/our-second-team/

A “place setter”(sic) implies he is holding the seat for someone else. Whom might that be ?

What I see is that he was one of 19 patriots who did the right thing in the face of evil. Carpetbagger Liz is the DC Establishment pick, and that’s why Wyoming Conservatives are saying NO to her candidacy.

>> Oh, so he's NOT the author of the internet taxation bill, right? <<

Well, let's see, his name isn't Jesus Christ, so he you've got me, he didn't vote absolutely 100% perfect 100% of the time. I guess his support of one bad bill means we should replace him with someone who is pro-amnesty and pro-radical gay agenda. Somehow that would be an improvement, right?

>> And he's been really, really effective......right? <<

He's been rock solid 95% of the time and is totally supportive of us when we need him on important legislation. If you want to see a worthless RINO who routinely stabs us in the back when we need him, try Mark Kirk.

>> And he claims to be one of Harry Reid's best friends, it's been his ability to work with them that Enzi values.... <<

Actually, only Liz Cheney and her fan club makes this claim, in order to smear a good conservative. I've never heard Enzi talk about how much he loves "reaching across the aisle" and "being bipartisan with Obama". Instead, every press statement he puts out talks about he how he opposes the Dems. And that's true long before he had a primary opponent.

>> The only reason he voted for this was the same reason Juan McCain became for the border fence when he was reelected. <<

Funny, I don't remember McCain being solid on border security before his primary challenge, but I certainly remember Enzi voting against Obamacare every step of the way, long before Dick Cheney's kid decided she wanted a senate seat in another state.

>> dude's a fake, flame all you want <<

The only fake is his primary opponent running as a "true conservative" and a "anti-establishment fighter" when she's part of the Washington status quo and considerably to the left of him on numerous issues.

>> we don't need back benchers <<

Yeah, because every single one of the 100 Senators should have extreme clout to get whatever they want, including the Senators from Wyoming. I'm sure that would work well in our government. I've actually had quite enough of "conservative" Senators from the middle of nowhere getting undue clout in the Senate and holding it hostage for the benefit of their state (perfect example being Senator Thune using John Bolton as a human shield to get pork for South Dakota).

Add Landmark to the mix, and I think Liz Cheney now has a whooping five supporters on FR. Well, it's a start!

The Internet tax thing is bad, it’s also the ONLY actual major problem I’ve heard of in regards to Enzi. Do you have something more (besides vague claims that he’s “friends” with a liberal or reads the NYTimes or something?)

I wouldn’t replace that with CHENEY’s daughter. Find someone who’s actually an improvement rather than a step down.

I doubt you’d have given a thought to primarying Enzi if Liz wasn’t running, the real problem is that he’s in her way, right? Friends of the Cheney family are cooking up this “Enzi is a RINO” meme, it makes me sick. I’m saddened that some people are buying in. Which radio talk host is ginning you up?

I’ll reiterate, he’s not super great or anything but he looks solid. I’d trust Liz Cheney a lot less. The idea in challenging incumbents is to IMPROVE the quality of Senator not to downgrade it.

Lizzie Cheney is a joke here in Wyoming.

You people from outside Wyoming might laugh at the fishing license gaffe of Cheney, but it crimped her support here. It is, as I have detailed here on FR, a sure sign that she is NOT a Wyomingite, has lived outside the state long enough she doesn’t know jack about the state, and she’s a carpetbagger.

Meanwhile, even Lizzie’s mommy, Lynne, has been sniping at old-time Wyoming politicians like Al Simpson when he wouldn’t sign a football for some cancer benefit because Simpson didn’t know if the football was going to be sold for political gain.

The Cheneys are quickly proving themselves to be less than classy people in this state.

Yea, that 322 acres of BLM ground for a shooting range he just got re-allocated near Powell proves he’s a fake.

Riiight.

I seriously doubt Lizzie could find Powell on a map.

Thanks, that’s an excellent point that didn’t even occur to me, how much time has even spent in the state, EVER let alone recently? Her home is the DC area. If she’s elected she’ll go back to Wyoming only for a photo-ops.

Maybe she should run for DC “Shadow Senator”. “Incumbent” democrat Paul Strauss is up for “reelection” next year. ;p

More seriously I think she’s actually spent most of her life in Northern VA. Warner doesn’t have a serious opponent yet AFAIK. Why not run there Liz? Oh right that would be more of a challenge than smearing a fellow Republican in a safe seat.
