Senator Marco Rubio withdrew his support for Judge William Thomas nomination Tuesday to the Federal District Court for the Southern District of Florida despite having backed the nomination more than 10 months ago, according to the New York Times.
For confirmation to move forward, a nominee must have support from both United States senators in their home state.
Senator Rubio said he was concerned about two decisions in cases made by Judge Thomas. If Thomas had been confirmed to the court, he would have been the first openly gay black judge on the federal bench.
Rubio said he was concerned about Thomas fitness for the federal bench including questions about his judicial temperament and his willingness to impose appropriate criminal sentences, according to the Times.
Specifically, Rubio took issue with the sentence of Michele Traverso, saying the sentence was too lenient. However, the lead prosecutor and the administrative judge for the 11th Judicial Circuit criminal division both wrote letters saying Judge Thomas acted fairly and well within the law, the Times reported.

TWO ISSUES RUBIO TOOK EXCEPTION WITH:
1) Rubio said he was concerned that Thomas gave too light a sentence to a motorist who killed a bicyclist in a hit-and-run accident. The driver was suspected of being intoxicated at the time, but since he did not turn himself in until the next day, his blood-alcohol level could not be measured, so there were limits on the charges that could be brought against him.
2) Thomas ruled against admitting a confession as evidence in a rape-murder case, saying two of the five defendants had not been read their rights properly or had not understood the information, and an appellate court agreed with part of his ruling. All five eventually either entered guilty pleas or were convicted.

Rubio is worried about how his support for this judge might look as he plans toward 2016 and the presidental race.
After his amnesty association with the gang of 8, Rubio seems to have wised up a tad.
Rubio’s stance on amnesty requires that every decision he makes henceforth should be viewed through the prism of political triangulation, and never again to be trusted.
Another little side dividend from sending his poll numbers into the toilet over amnesty.

Never forget, he’s Hispanic and he will do for “his people” given the chance again irrespective of our country’s laws or the interests of it’s citizens. He is not presidential material.

The absolutely despicable Marco Rubio is trying to do anything he can to reestablish his bona fides as a conservative. Sorry Marco, it won’t work! I, and many others, will FOREVER remember your treachery on Amnesty.

Rubio needs to get his butt on the Senate floor and help out Ted Cruz. Then maybe we can think about starting to listen to him.
