SPRINGFIELD - Kimberly Chartier - whose husband died of cardiac arrest in the stands of a New England Patriots game in 2010 - has filed a civil suit in Hampden Superior Court against the team and the National Football League.
Chartier, of Chicopee - who is suing on behalf of her son Tedy - is seeking at least $10 million alleging the Patriots, the National Football League, and three other parties are responsible for the wrongful death of her husband Jeffrey A. Chartier.

It’s an unfortunate situation - lack of both communication & finesse on the part of security, and the NFL officials may have overstepped in INVITING the young boy onto the field. Not the fault of the Patriots, but security.

The immediate and proper response that would have saved his life, or at least deferred the oncoming MI would have been, "Then go talk to the NFL officials. They issue credentials, not I."
Then turn away and return to your seat.

Exactly. TeamOps LLC would be the appropriate party to file suit against. But the Patriots have far deeper pockets. If she did not name TeamOps LLC in the suit, she'll wind up with nothing.
It helped to read the article (something I rarely do) as this wasn’t just a case of a guy in the stands having a heart attack.
The NFL and Patriots did basically stuff pork rinds down his throat. Something this guy didnt need.
I would like to know if security acted professionally and Chartier turned into a crazed hot-head (when has that ever happened to a Boston sports fan?) or if security turned their rent-a-cop attitude up to eleven (and when has that ever happened). Either way, from the picture it looks like he could have had a heart attack the first time the Patriots went into overtime.
.....years ago I watched a security guard (an Obama son look a like)at a Indy car race at the Meadowlands... tried to stop AJ Foyt in the pits even though AJ had all the ID’s needed to go where ever he wanted hanging from his neck...
...it got ugly quick with AJ showing the uninformed guard his credentials close up....inches from his face....it took 3 of his pit crew to drag AJ away...*LOL*
No, they didn't. Perhaps the NFL was negligent in not getting proper creds for the kid but the security guard who was doing the 'pork rind stuffing' was a representative of TeamOps LLC...not the Patriots. I'd be surprised if the contract with TeamOps LLC did not contain language that makes the Patriots organization not liable for any injuries sustained in contact with a TeamOps LLC employee. And the back of the deceased's ticket would indicate that.
i agree... however, after reading the entire article, a big part of me wants her to sue the stupid security guard... what an a$$... do most security guards suffer from banty rooster syndrome?

Who hired TeamOps? The NFL and Patriots. I’m sure the contract does contain language as you say, it doesn’t really matter. Generally ‘gross negligence’ will void those types of clauses.
Once they invited the kid onto the field the terms of any contract changed.
Whatever the NFL and Patriots end up pay this woman will equate to a rounding error in their annual budgets.
The real tragedy is that there won’t be any more children invited down onto the field in the future.
a disclaimer on the back of a ticket does not necessarily provide blanket protection... just as when a parking garage has a sign that says “Not Responsible for Damaged or Stolen Property.” we shall see how the Boston courts handle this...

The difference between AJ and his father was amazing.
Buddy of mine was sitting on a plane right beside him as he was going home after being taken out of Indy on the first lap by a rookie. AJ was in rare form that day.
Was her hubby wearing his medic alert bracelet stating “I am fat, overweight and at risk for heart attacks” so that the security guard would know to treat him nicely?
Most security people suffer from the same ailment many police officers suffer from. They have a little bit of authority and they get carried away with it’s use.
