U.S. Army veteran Jared Goering was kicked off the North Wildwood boardwalk Thursday night because he had his service dog by his side.
A North Wildwood police officer issued Jared and his wife a summons because of the dog. Goering said, I expected to get more respect from him because of the jobs that we both have to do."
"He mockingly asked if all veterans get service dogs," said Jareds wife, Sally Goering, his dog is medically necessary and he is a service dog."
Jared and his wife Sally say the incident occurred on the 26th street North Wildwood boardwalk. The Goering family said, even after showing the officer the dog's service identification card, he still issued them a summons and kicked them off the boardwalk.

The only way to get respect from assholes like this is to sue the city, people with no common sense shouldn’t be allowed to be police, the taxpayers in their jurisdiction have to pay for their stupidity.
Totally illegal. The veteran is protected under ADA. Also it is a crappy way to treat another human being, especially one who served his country.
I am not sure if he would file a civil complaint directly with DOJ under ADA or if VA has their own division handling ADA complaints. The service animal is 100% permitted to be in any public place.

Exactly. States can pass stricter standards than what is found in Federal ADA but they can not weaken it or nullify any of its provisions. Questions on service animals are a non starter since you can hardly draft stricter legislation regarding them.
Just for the fun of it I would love if someone went to Wildwood and documented all the ways Title II of the ADA was violated by that municipality.
An enterprising shyster could make a handsome sum for himself and the vet, without breaking much of a sweat.
