Who did HE vote for?
Jay Carney, Austin Goolsbee, many others. They just can’t conceive that a business owner would take legal steps (as stipulated in the legislation) to contain costs and protect their investment. It is as if they have no concept of self-interest.
I was talking to a friend who owns a business. He said he was going to have to put his folks on part-time. It was causing him a lot of grief and I suggested that in some cases perhaps he could offer to hire a family member of the employee and the combination of the two jobs would end up with the same income for them. He’s thinking it over and was enthusiastic.
Might help mitigate the pain in some cases...and he would have to hire more part timers anyway.

Why not just make all employees independent contractors? They no longer have the term employee. The only difference is that they pay their own taxes and nothing is withheld from their paychecks. I know some who are also taking this route.
But it creates MORE jobs! Three 40 hour jobs become four 29 hour jobs. Voila! You just “created” a job and Barry gets credit for it!
There are a lot of requirements put forth by the IRS in order to be considered an IC. I did medical transcription for over 25 years and ICs were rampant there. Things like no set schedules, which I really can’t see being a realistic work environment for most companies.
I realize that and i, too, have worked many years as an IC. It is an alternative to paying the obamacare “tax.”
The way I understand it is if you provide a place in your business for that person to work, then they are an employee and you must withhold taxes. An independent contractor works away from your brick and mortar business. Don’t think this will work for a grocery store.
Have you taken the time to investigate what does and does not constitute being an independent contractor? I suggest that you do.
I not only have taken the time, I have worked as an independent contractor for various companies. And, I also know some business owners who are going this route.

I happen to be a retired attorney. Merely asserting that a person is an independent contractor does not him or her so. Certain criteria must be observed to qualify a person as an independent contractor. This issue frequently arises when a third person suffers damages and seeks the deepest pocket and the courts determine which party is liable for damages. You can bet your bottom dollar that the federal government will look very closely whether one is truly an independent contractor or an employee being disguised as an independent contractor to avoid some liability.
Is monocle a Mr. Know-It-All?
BTW, in another life I worked for a state agency (workers unemployment compensation) that dealt with this very matter literally every day. The courts held then-and I’ll bet they hold now—the very concepts that monocle laid out.
