Military prosecutors want two potential jurors tossed from the murder trial of the Fort Hood shooting rampage suspect because the Army officers indicated they opposed the death penalty.

Four colonels and two lieutenant colonels were brought in from Army posts nationwide and overseas on Monday as questioning continued in the court-martial of Maj. Nidal Hasan. …

But I though courts martial didn’t have a jury, just a panel of officers?

How can you be in the military and be opposed to the death penalty? Outside of conscientious objectors, if you’re willing to kill anonymous foreigners why not domestic murderers?

Killing Nidal Hasan (or even just giving him a dishonorable discharge) would upset the diversity of the US military and according to top brass THAT would be a bigger tragedy than the willful murder of over a dozen unarmed Americans.

IIRC in a civilian trial the jury must unanimously recommend the DP before it can be imposed.I wonder if the same is true of a court martial panel.

Never having run afoul of the UCMJ during my stellar (ahem) Army career I know little about courts-martial but is it true that in a court martial all members of the panel must outrank the defendant?
