Nullification Anyone?

"We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America."

Of course anyone who paid attention to ABC's "Schoolhouse Rock" within the last 40 years knows this is the preamble to the Constitution. In this day and age, when Washington legislation weighs more than most Thanksgiving turkeys, the founders of our country were able to succinctly describe the purpose and scope of the federal government in four eloquent lines.

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."

This one's not as well known, but it's the Tenth Amendment, which basically gives any governmental power not specifically enumerated in the Constitution to the states. Politicians like Harry Reid and Nancy Pelosi have long forgotten this amendment, and unfortunately most citizens have lost sight of who's truly in charge of our republic, and as a result we're left with the bureaucratic nightmare we see in Washington.

This brings me to my call for the use of nullification. Nullification is a legal theory in which a state can "nullify" any federal law that it deems unconstitutional. I'm not alone. According to the Rasmussen poll taken in May of this year, "52 percent of mainstream voters think states should have the right to block any federal laws they disagree with on legal grounds."

Problem is, there is what Consitution says and then there is what the Federal Courts have said that it says.

What we see playing out in Egypt now could be us within another year or two. ObaMao has control of Chuck Hagel. Churck Hagel probably has control of the joint chiefs of staff. But do the joint chiefs of staff have control over the military rank and file?

Ain’t got a right to free speech or religion if you are a christian, Ain’t got a right to arms, Police in Nevada claiming private residence for themselves, Got no knock warrants and the NSA, Due process and eminent domain are gone, Speedy trials are now media show trials, federal juries are unreliable boot lickers, Cruel and unusual punishment for citizens compared to aliens of the same offense, the 9th is ignored by the 9th circus courts, and the 10th has turned from being a protector of liberty to the justifacion of “wickard” people who have not had their “fill-born” of federal power.....

The power the Federal government has is taxes.

And constitutionally, that only consists of excises, capitation taxes, tariffs, and such other taxes as amendments empower them to collect (i.e., income taxes due to the 16th Amendment, etc.) Nothing else. Any tax levied under any other application of the taxing power is constitutionally invalid.

Andrew Jackson on "nullification" theories:

"Tell them from me that they can talk and write resolutions and print threats till their heart's content. But if one drop of blood be shed there in defiance of the laws of the United States, I will hang the first man of them I can get my hands on to the first tree I can find!"

He didn't say anything about hanging women, though, so maybe there's a loophole.

Zero, but the statist "Federal" Government has a whole bunch...more importantly they control a lot $$$ that the states and local governments have become addicted to. As Bruce Springsteen might have said if he were a conservative...that federalism is gone boy and it ain't' coming back.

My question is about the existing legal mechanisms for “ we, the people” to remove a SC justice when his/her ruling violates The US Constitution?

Only if tens of millions of Americans are starving to death, as is the case in Egypt.

But given the imperatives of Agenda 21, maybe that isn't so far-fetched. Obama might try to speed up the Soylent Greening of America for partisan political purposes.
