This ruling means the opposite of what you are saying. The people of CA voted to amend their state Constitution to define marriage as the union of a man and a woman. A judge said the voters could not amend the CA Constitution that way because it violated the federal Constitution. And SCOTUS ruled that the voters have no recourse to find out whether the judge overstepped his bounds when he overturned their election results.

This ruling means that for the time being an unaccountable state judge can keep the people in his state from amending their state Constitution. And it means that the voters have no way to get a final answer on whether the 14th Amendment means that states have to include ALL combinations of “persons” in their definition of marriage.

For Chief Justice Roberts to say that it is not the voters’ business whether their vote counts is a denial of due process to the voters. It is a weasel way to make sure that the voters can never get answers. If having your vote overturned for no lawful, Constitutional reason doesn’t count as justiciable harm, then a voter can never be harmed - because their vote doesn’t matter anyway, since a single judge can undo an election without the reason having to pass Constitutional or lawful muster.

In short, this decision means that no vote even matters, because it is legally no voter’s business if the result of the election is unlawfully overturned by a judge.

If he truly believes there is no potential harm done to the voters when the result of an election is overturned without just cause, then what the heck does he think elections are for? Why do we even go through with the charade of having elections?

Yes I am unreconstructed. I believe in the republic as originally founded with limits on Federal power and few limits on state power.

Roberts didn’t object on the grounds you state. With regard to Proposition 8 he stated the people bringing the case before the court didn’t have standing because they weren’t homosexuals. Say what?

Proposition 8 was struck down by the Ninth Circuit Court of Appeals. That put it on hold, because it was most certainly going to be referred to the Supreme Court.

Then Roberts joined what became the majority with his vote, that those bringing the appeal didn’t have standing. Say what? It was being appealed by those who didn’t want homosexual marriage to have even status with heterosexual marriage. Why would he think you had to be a homosexual to have standing?

As for the 9th Circuit, it should have kept it’s nose out for precisely the reason you stated, a state’s rights claim. Roberts could have addressed that and said what you did. He didn’t. He punted.

If I’ve got this wrong, explain it. Perhaps I’ll agree.

If you are a Republican as Roberts supposedly was,to be labeled as gay is a political death sentence.Is that good enough answer for you?Gays are not accepted by a majority of the population. If one of those demented Aholes ever messes with any of my grandchildren they will cease to exist.
