Roberts Blows Gay Marriage (Roberts, Not Kennedy Was Critical Here)

But that’s not how they came out. The liberal wing of the Court plus Kennedy struck down DOMA, with Roberts dissenting on the issue of standing to sue. Then the Court punted on Prop 8, holding that the plaintiffs (hey, they weren’t a gay couple) didn’t have standing. On the standing issue Kennedy and Roberts were consistent. Kennedy didn’t see a standing problem in either case, Roberts did. Both cases were 5-4.

I don’t have the second case in front of me but here’s what I think explains what happened. The liberal wing, voting strategically, didn’t see a standing problem in the first case but did in the second. In doing so they got the result they wanted in the first case and avoided a loss in the second.

So who’s to blame? Not Kennedy. Roberts. Had Roberts, as he well might have done, come out the other way on standing, I surmise (reading between the lines) that there would have been a 5-4 majority reversing the Ninth Circuit and upholding Prop 8.

In short, this is a replay of the Obamacare decision of a year ago, in which Roberts nimbly managed to produce a result that did not displease the left.

Roberts is going to wind up being one of the most destructive forces the court has ever had. On issue after issue he’s going to find some way to circumvent normal logic, and act on behalf of the Left.

Homosexuality is a sin, not a class of people (Leviticus 18:22).

It is a sin that needs to be repented of and forsaken like all other sins. The Supreme Court blew it big time and caused harm to America, our values, and our way of life.

Perhaps Chief Justice Black was blackmailed again over his adopted children. God knows Barack Hussein Obama gives every sign of being Gay or Bi, so he had a vested interest in the case’s outcome here, as he also did with ObamaCare.

wow...

can somebody pull out their handy dandy pocket sized copy of the constitution, and tell me where marriage is a power SPECIFICALLY granted to the federal government???

‘cuz, according to that pesky ol’ piece of paper, if a power is not SPECIFICALLY granted to the feds, then it is reserved by the states and the people, respectively..

now, tell me again, how did roberts blow it????

There was certainly no doubt how Ginsberg, Sodajerk and Kagen would vote, Kennedy is always a crap shoot.\\

This will make absolutely no difference to me.

A state passes an amendment to their own Constitution. A judge in that state says that the amended state Constitution violates the United States Constitution. One of the states’ voters sues so that the federal Constitutional issue can be settled, and the Supreme Court of the US says it is nobody’s business whether or not their state Constitution can stand as amended.

So if a voter doesn’t have standing to challenge the ruling of a judge who overturns an election, who does? How are they saying the system is supposed to work, so that an election actually matters?
