Joe Scarborough’s saying that because there aren’t any blacks on the jury, if Zimmerman is acquitted the verdict should be immediately overturned by appeal. The defense is allowed to appeal on that basis.

I doubt the prosecution would be allowed.

Good lord, I can't believe what I just read. Why would the DEFENSE appeal an acquittal under any circumstances? As for the prosecution, they would love to be able to keep trying a case until they finally got a jury to agree with their version of the truth but they can't. If you are acquitted, you walk. Any attempt at retrying the case would be double jeopardy, which is not allowed.

What I meant was that the defense could appeal a verdict they disliked (conviction) but the prosecution could not appeal an acquittal. If Zimmerman is acquitted, then that's it.

I think the prosecution is hoping for a hung jury, with at least one of the women being steadfast for conviction. The prosecution could then say to Zimmerman "We will have another trial, We have all the time and money in the world to keep this going until you are bled dry, financially. You sure you don't want to plea bargain?"
