Sheriff Nick Finch has declined to comment on his arrest. His attorney, Jimmy Judkins, released the following statement:
"The records at the jail show exactly what happened in this case and the records speak the truth. The sheriff looked at the facts and said 'I believe in the second amendment and we're not going to charge him.' That is not misconduct at all. That is within the Sheriff's prerogative whether to charge someone or not."
When the charges are dismissed? None.

Agreed. So if it's as simple as that then why the need to destroy all evidence of the arrest? That's what he's charged with.
It's possible he let a buddy go, then when he got caught he said he was defending the 2nd to drum up some support. Who knows? I don't.

I'm wondering if that's the case, and if so then he isn't really the martyr that he makes himself out to be. And that his motivation isn't the 2nd Amendment but his buddy's hide.

We need more info on the arrestee. In Chicago, a mobster was arrested for carrying a gun, which is a felony, but he was also a felon, making it all the worse. An Alderman came in and walked the mobster out of the police station. The officer later stated that he was mistaken. Is this the same kind of deal? I’d like to get more info on the whole thing.
Question to which I cannot find any answer:
DId the man arrested for carrying a concealed weapon HAVE a concealed carry permit? If so, why was he arrested? If not, what is the local law on concealed carry?
Was the carrier a convicted felon or a law-abiding citizen?

The “why” isn’t really important, if in fact he actually destroyed or altered records.
LEOs need to be held to a high standard, above reproach, to enjoy the sweeping power given to them. If he indeed destroyed records, then he can’t be trusted no matter how pure his motive was.

Was he covering up wrongdoing or defending the Constitution?
This could go either way.
0.E.O seems to be proposing that the fellow(s) whose documentation was destroyed not have been arrested in the first place; rather, said fellow(s) ought not to have been charged.
If he determined that the arrest was not based on probable cause and thus was in violation of law it would be appropriate that it not end up on this guys criminal history in NCIC.
Until we get more info, im holding off judgement...This is yellow journalism at its finest...it gets everyones bowels in an uproar...
I agree some of this stuff being reported is really suspect...
I want to know the nature of the original arrest of the gun toating citizen...did they have a permit to carry? If not was it active, suspended, revoked...or just misplaced...
We need a lot more info before Floridians storm the Bastille...
