There lies the problem. Congress will argue she’s not covered. O will say she is. DC judge ( most are in O pocket) will adjudicate. It will be appealed SCOTUS will decide for congress
But time will have passed. That’s his game : run out the clock and do as much damage as he can while it is ticking!
