They can use the word scouts. Many organizations already do. The Baden-Powel Scouts use it. Hell even Girl Scouts use it. It is a generic term and can not be copyrighted.
I'm sorry, but you are incorrect.
The Girl Scouts received a Congressional charter to use the word in 1954. They, along with the BSA, are the only ones who can use it.
BPSA stands for "Baden-Powell Service Organization. They use the word informally, but are not legally allowed to use it in their name.
Whatever the new group will be called, it won't include the word "Scouts".
