simple US law prohibits citizens even naturalized citizens from being held or tried as enemy combatants. The admin could revolk his passport and strip him of his citizenship but that is not likely to happen. If held as an EC once his surrender is accepted he would be legally afforded all the rights of a captured prisoner of war and could not be executed without a military tribunal, his home country could petition for he return and since we are not at war with Chechnya we would be obligated to return him unharmed per the Geneva convention. unless we can prove he was a spy. No this admin is doing the right thing try him as a citizen under our federal law system and execute him as the traitor he is.
