He may have gotten by the negligent, incompetent misled DHS, the FBI, ICE, the lax immigration policies, etc, etc, and he may have been awarded citizenship, but that does not change the undeniable and obvious fact that he turned TRAITOR and joined the Islamic enemy in their continuing bloody attacks on America and innocent American citizens (and others). Yes, that is TREASON and the moment he joined in on this treasonous operation he became an enemy combatant!!

Read, study, understand and abide by the constitution!!

A quick trial followed by a short drop would be justice. Dragging his butt through decades of civilian trials and endless appeals while pampering him with hot meals, a cot, lawyers, press exposure, TV, internet, a rug to pray on 5 times a day, medical care and all the prison sex and dope he can get is not.

So would a charge of treason be required to be prosecuted by military tribunal? How would the charge of treason affect the charge of terrorism? I just don’t know enough about military tribunals,etc.

In 1942, the SCOTUS assigned the case of an American citizen to a military tribunal -- as he had acted against the USA in service to a foreign power during a time of war.

Thanks for the link! Not sure which ‘foreign power’ we could say he is fighting for at this point. I think that is why the Bush administration had a ‘War On Terror’ to begin with perhaps. No wonder Obama wanted to end that legal designation so fast. I just hope he pays with his life in the end.

You can start with libertarian Andrew Napolitano (who I usually respect) but who was just on FOX News bleeding for this bloodthirsty traitor’s constitutional rights. This POS Islamic traitor has NO RIGHTS. He gave them up when he became an enemy combatant by joining the Islamic war on America and carrying out his bloody militant attack on American citizens on American soil!!

I respectfully disagree. Of course, the guy became a traitor the moment he joined up with the Islamic enemy and set his sights on Americans. But, that doesn't mean he gave up his rights (after all, the Constitution specifically sets forth rights for those accused of treason). The point of Constitutional rights for people accused of crimes, even heinous crimes like this one, is not simply to protect the rights of the accused. It's also to protect everyone else, by limiting the power of the government, and expanding the power of the people.

Taken together, the 5th amendment right to due process and the 6th amendment right to trial by jury mean that the government does not have the power to deprive a citizen of life, liberty or property without due process of law, and that such due process must include the citizenry (as represented by the jury). Allowing the government to ignore all of that, name a citizen as an "enemy combatant" and deny him due process--even where, as here, he has committed a heinous act, even an act of war--represents a tremendous expansion of the power of the government, and a corresponding decrease in the power of the citizenry. Sure, it might yield the "right" result in this case, but once you allow the government to do that to one guy (even a scumbag like this), it makes it that much easier for them to do it to someone else (and don't think for a second that the 0bama admin wouldnt love to do it to a "radical" Christian preacher, or tea party "militant").

Nope. He forfeited any constitutional rights he may have had the moment he signed on as an Islamic militant combatant as a soldier of death (jihadist). He belongs in a military prison where they can extract all the information they can about his Islamic comrades and Islamic terror connections and ongoing terrorists plots, then a speedy military trial and a short drop from the hangman’s platform.

Let it be known that swift justice awaits treasonous Islamic terrorists.

I’d guess that 9 out of 10 libertarians on FR are for secure borders, no amnesty, traditional marriage, etc.

Do we even have any capital “L” Libertarians around here?

Regardless of what Obama has said, the War on Terror is still officially underway.

There has been no formal "cessation of hostilities" statement or procedure nor has there been Congressional action to withdraw the Resolution to Use Military Force.

The ones taking that position on FR are more likely to be constitutionalist Oath Keeper types, who fear the possibility of the government abusing the concept of treason in order to use it against patriots.

I agree that this scumbag jihadi deserves that. But I don’t trust the government (certainly not THIS government) to make the call as to who does and does not have constitutional rights. I won’t shed a tear over this guy, but I will worry a little bit about who’s next.

Hey, I'm with you on this one. I'm just saying the folks taking the other position on FR aren't going to be libertarians for the most part. They're going to be conservatives of a certain stripe.

By the way, I’m a constitutionalist Oath Keeper myself. Swore an oath as I joined the navy to defend the constitution against all enemies foreign and domestic. An oath is forever. And I post on FR and have posted on OathKeepers using my real name. I’m a Christian (not necessarily a good one), a believer, a veteran, an old white man (100% biased toward God, Life, Country, Family, Constitution), cherish my God-given right to keep and bear arms as well as all my other god-given unalienable rights, count myself as a conservative, a patriot, a tea party member, and I’ve never harmed another human being (unless some of the shells we fired into the battlefields of Vietnam from the destroyers I served on killed some Viet Cong communists) nor have I ever threatened to. Jackbooted Marxist/fascists Obama and Janet Napolitano can kiss my white English/Irish (eighth generation descent) American arse!! They have nothing on me and never will have.

Disagree.

The oft-used "slippery slope" argument with regards to Govt abuse of power has too often been proven correct in the 20/20 vision of hind sight.

How "treason" is defined today will no doubt "evolve" to fit the political agenda of this and/or future administrations. Dzhokhar's bombing acts are "treason" today, Joe Six-Pack's defiance of NY or CT's gun laws are "treason" tomorrow.

If Dzhokar is a US Citizen he should be tried as such with full Constitutional Rights. We may end up learning something from his trial - perhaps about our own government's gross negligence and/or wilfull misconduct.

I would advise anyone not wanting to be charged as a treasonous enemy combatant to not join the Islamic enemy and plant bombs on US soil to kill and maim US citizens and other innocent bystanders. Pretty damn simple, eh?
