"Is there a Massachusetts death penalty?"

Not anymore....I used to work at Walpole many years ago, where they still had "Sparky," but it was getting pretty dusty.

But could be a Federal crime, not sure. Normally State would take precedence unless interstate activity can be shown.

McVeigh was convicted in federal court on federal charges because it involved US Government property, and US Government employees. Terry Nichols was charged, tried, and convicted in Oklahoma state court for the deaths of non-government citizens, since he was distant at time of explosion.

I’m not an expert, but I do not see any federal connection (absent cross state lines activities); hence state charges.
