“Get a lawyer. Threaten to sue the retards at the school and they’ll stop this BS. It works for everyone else, it SHOULD work for Americans. Maybe not but it’s worth a shot.”

To sue you have to have a cause of action; being pissed-off won’t do. Also, it costs $5000 down and $500/hr to operate the legal system. The legal system is not usable unless you have a 3rd party paying the bills; like the government. If he were black, gay, Indian, etc. and it was a “hate” crime he could sue regardless. (I had a lawyer tell me that if I fit one of the protected categories he’d take the suit even if I was lying to him. He said the other side knows the government pocket has no bottom and he could force a settlement regardless of having a case or not.)

First Amendment applies. Government issuing punishment for constitutionally protected speech, especially without the benefit of a specific policy framework, would work just fine as a basis for action. Still would need to navigate the precedents carefully, Tinker, Fraser, Hazelwood, etc. But doable.

As for cost, there are any number of con law firms, mostly for Christian legal fights, that are donation driven, and might well be able to help out on a pro bono basis. Furthermore, lots of lawyers right now hungry for any kind of work. Trust me on this. The kid could get help for way less than 500/hr. Just needs to shop a bit.

He could always see if a more principle lawyer will take his case pro bono.
