New York City is asking appeals judges to reinstate a ban on supersized sodas and other sugary drinks, which was struck down by a Manhattan judge the day before it was to go into effect.
The city had vowed an appeal and said Thursday that lawyers had filed it late Monday.
In his decision on March 11, State Supreme Court Justice Milton Tingling said the 16-ounce limit on sodas and other sweet drinks arbitrarily applies to only some sugary beverages and some places that sell them.

You are right, and to add to that, It’s nobody’s friggin business what I choose to drink or how much.
Next they will be telling what time to get up and what time to go to bed.
I’m guessing it’s because they have a good lobbyist.
Bloomberg has made his whole career by distracting New Yorkers from rampant crime and unendurable crowding with a lot of smoke and mirrors about firearms and sodas.
New Yorkers deserve to be held in contempt for letting this loudmouth megalomaniac get away with it.
I read it is because the state government regulates state-wide establisments, like 7-11.
In a saner society, Bloomberg would be tarred and feathered by now.
In prison they do that already, and if we keep going in this direction, we may lose enough freedoms, that it will seem like we are in a prison house.
This is a society that has been “public schooled” to the point where it will never stand up to the government over anything.
