The 22nd Amendment would still apply to Obama as he came into office under it. Any repeal would apply to his successor.

Okay, so Biden gets elected president. Then after his first term decides not to run again. Can Obama come back? It’s more than two in a row he can’t do, right? Just asking.

If Obama wants a third term, he'll get the Roberts court to OK it--perhaps by a ruling that the 22nd Amendment doesn't apply to blacks.

Hmmm...What universe do you reside in? Name a single instance in the past 4.5 years in which his majesty has ever deferred to the former laws of the U.S.

0bama has repeatedly thumbed his nose at The Constitution. His mere presence in the oval office is proof of that. What makes anyone think he will vacate the office just because his term expires? DHS is not buying tanks and stockpiling ammo for nothing.

One might think that. The 22nd amendment didn't apply to Harry Truman, who was President when it went into effect.

But the sitting president -- whoever was president when the amendment was passed by Congress or ratified by the states -- was explicitly excluded by that amendment.

Serrano's amendment doesn't explicitly exclude the sitting president, so it's possible Obama would be allowed to run again if the amendment is ratified by the election.

It would make an interesting case in court. I don't see any of that happening, though.

That didn’t stop Jerry Brown.

The Governor shall be elected every fourth year at the same time and places as members of the Assembly and hold office from the Monday after January 1 following the election until a successor qualifies. The Governor shall be an elector who has been a citizen of the United States and a resident of this State for 5 years immediately preceding the Governor’s election. The Governor may not hold other public office. No Governor may serve more than 2 terms.
— Article V, Section 2, Constitution of California.
