Prosecutor, esp a female, should know better. It’s ‘too impaired to say “yes”’, although it’s not as if a 16yo girl can grant consent (legally)
The boys were 16 and 17. Most states say the underage girl becomes legally capable of consent if the other party is close to her age. (This is stupid, but it's necessary if we're going to have a society of teen fornication without a lot of criminal trials.)
In Ohio she can.
The “girl” (about same age as the “boys”) has been declared “innocent” of any and all responsibility for her own actions. The perfect “feminist” of the future. There’s a lesson in this for teenage girls, too; but evidently it has been missed.
If any woman is in even questionable shape for giving consent and has not absolutely demonstrated or verbalized such consent, it's a "No."
(When there is any doubt, that should be the default assumption.)
