Possession of Firearms in Home, begets New Jersey Man 30 days in Jail

Hudson County, New Jersey --(Ammoland.com) At approximately 10pm on Thursday night, January 24, 2013, 33-year-old Keith Pantaleon of Jersey City, New Jersey, was in the bedroom of his apartment watching television after a full day’s work – when he heard thumping noises coming from his living room.

Believing that his residence may be being broken into, he grabbed his soft-bound Day Planner case (which also held a lawfully purchased handgun), and cracked open his bedroom door to investigate.

In the center of his living room, he saw a man dressed entirely in dark clothing who had his back towards him. He cracked open his door slightly further and saw near the entrance to his apartment a police officer, his landlord, and an EMT worker.

When the man dressed in dark clothing in the middle of his living room turned around, he saw it was another police officer.

One of the officers immediately ordered Pantaleon to come out of his bedroom. Pantaleon tossed his unopened Day Planner case onto his bed. As he went to close his bedroom door behind him, one of the officers pushed him into his living room. The officer then ordered Pantaleon to face a corner of his living room and handcuffed him. One of the officers allegedly threatened Pantaleon that if he had pulled out a firearm, he would have shot him. Officers asked if Pantaleon owned any firearms. To which, he did not reply.

As one of the officers watched Pantaleon (who remained in custody in Pantaleon’s living room), the other officer warrantlessly searched Pantaleon’s bedroom – which including opening cabinets and his Day Planner case – then demanded that Pantaleon provide the PIN# combination to his safe, which the officer proceeded to open and search.

this is pretty damned blatant... I almost feel like there should be more to this story. Of course, I'm always skeptical of stories like these no matter which side tells it.

Don't get me wrong, I'm no fanboy for authorities and the abuses they tend to get by with. I believe we need to go back to holding the individual LEO's personally liable when they violate someones rights instead of punishing the taxpayer and giving the cop 2 day paid suspensions.

So it's illegal to possess handgun ammunition in New Jersey? Including .22?

news article from original Jan 29 arrest. They apparently just walked into his house without warrant or justification.

Where’s the NRA? Let’s hope they step up to the plate and start spending some of their money to fight these unconstitutional acts and help people like this. The 3rd circuit is loaded with old Reagan and Bush appointees, would be nice to see some legal challenges for a change but these type of unlawful acts by police along with NJ’s unconstitutional gun laws seem to go unchallenged.

Damn! I grew up in downtown Jersey City. Eighteen of my 57 years. If you got mugged, raped, or assaulted, the police would usually ask, "Why weren't you carrying a gun?"

When I was 11, I had my baseball glove taken from me by a group of older boys in Hamilton Park. While we were cruising the neighborhood in the patrol car looking for them, One of them (there were 2 per car those days)looked back at me and asked why didn't use my knife. I told him I left it at school. he said "Don't forget it again."

Very true story.

Pantaleon lawfully purchased his firearms as a prior resident of Pennsylvania. He also possesses permits to carry firearms from Nevada and Florida. Pantaleon has no prior criminal convictions and no mental health history. He is not accused of misusing or threatening to use any firearms. No unlawful purpose for said possessions has been alleged. Despite the above, his bail was set at $75,000.00 cash or bond, which the 33-year-old did not have. A friend of Pantaleon’s, however, brought awareness of his matter on the Internet, which raised funds to hire the law firm of Evan F. Nappen, Attorney at Law PC to represent.

To Obama the constitution is officially null and void. He wants to be like is hero - the late Joesph Stalin and Hugo Chavez.

yea, that makes a lot of sense.

about as much sense as a resident calling the police because your heat isn't working properly.

I guess I could pick up the habit of believing everything I read, especially if it's something I want to hear.

Isn't evidence from illegal search inadmissible? This seems a no-brainer, even grounds for a lawsuit. But then: ...He cracked open his door ... and saw near the entrance to his apartment a police officer, his landlord, and an EMT worker.

Could it be that the landlord (standing in his livingroom) have provided all the permission the cops needed to invade?

Are renters denied Constitutional rights?

And why was the EMT guy with them?

Why would cops have had him along?

Because the cops knew in advance he had guns and expected a different outcome. It does sound like the guy has an enemy and was set up.

Expect more of such arrests when your friends/neighbors/relatives are told they'll get perks from turning you in. Heil, hussein!

There are horror stories about law-abiding gun owners being mistreated and literally abused over decades by law enforcement in New Jersey that could fill volumes. Hunters simply transporting firearms through the state, even people on layovers at airports with firearms in checked baggage have been given some very bad times in that hellish place. To think how many of our forbears suffered and died for liberty there...
