B. Todd Jones, the Acting Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, and Cathy Lanier, Chief of the Metropolitan Police Department in Washington, D.C., are being challenged on selective enforcement of the Districts ban on so-called large capacity ammunition feeding devices for semi-automatic firearms. This column will serve as a follow-up to an earlier request asking who authorized violation of the ban, after NBCs David Gregory produced a magazine during his Dec. 23 Meet the Press interview with National Rifle Association head Wayne LaPierre.
That request was documented by Gun Rights Examiner and sent to the respective agencies via email. Because the responses to very specific questions created more questions than answers, this column will now be used to transmit an open letter to the two law enforcement executives:
Dear Director Jones and Chief Lanier,
A crime has been committed, your agencies are involved, and someone is lying. Those are serious charges, but fortunately, theyre demonstrable. And until its cleared up, the actions and reputations of your respective agencies will continue meriting public scrutiny.
As you know, NBCs David Gregory displayed an ammunition magazine that is banned under D.C. Official Code 7-2506.01, and that a conviction on this charge can result in a maximum fine of $1,000 and/or up to one year imprisonment.
Thats pretty serious.
You also must know that media pundits as diverse as Howard Kurtz and Greta Van Susteren have scolded you for spending any time investigating this, calling any such effort a waste of time because Gregory didnt intend to commit any crime, and was merely scoring a journalistic point, even if it was ill-advised.

plenty of people go to jail for crime they didn’t intend on breaking.... so jail time for David Gregory
Two tiers of justice in this country:
Tier one: uber-rich, Muslims, and “progressives.”
Tier two: Everyone else.
Did NBC just send a researcher out to a gun store in VA to buy a magazine or does Mr. Gregory have a little secret stashed in his closet?
I am just waiting for them to excuse this because he is a journalist/reporter. If that is the case, I will have a website up with 24 hours selling press credentials thus giving everyone the same credentials as this putz. Of course, I am the same guy who tried to get my kids to sell soft drinks from their car when their high school decideded to ban soda machines in the schools. Kids wouldn’t do it! Could have paid for college!
EIther change the law or enforce it. I do hope they don’t enforce it because the law will be effectively neutered.
Press pass doubles as a get out of jail free card.
Soon to be popular: the “David Gregory defense”.
I sure hope so! I just received media credentials for the Shot Show.
as much as I hate “magazine bans”, I hate selective enforcement of laws more. Gregory needs to have his day in court.
If laws are demonstrated to be enforced selectively based on political views, can it be challenged in court up to the SCOTUS??
I once had the occasion to observe Chief Lanier up close in the way she handled an incident.
To say it nicely, I thought she handled it very poorly.
No, it will probably just be denied cert. < waves hand > These aren’t the Constitutional Rights you are looking for.
That’s what I’m thinking. If they end up banning my magazines I’m keeping them and demanding the same consideration - ie I can ignore the law too.
We are a nation of men, not laws.
You can bet they would have immediately surrounded the studio with a swat team had it been Hannity or Beck.
DC police: Congress’s campus cops. Motto: ‘Boys will be boys ‘.
I always heard: the best way to get rid of a bad law is to enforce it.
