The Tenth Amendment is not some sort of license to overturn the natural law.
It speaks only of legitimate powers.
To claim otherwise is contrary to everything the founders of this republic believed.
Congress may define the extent and qualifications of those who receive taxpayer benefits. Toward that purpose, and to head off the courts, Congress legitimately declined to extend such benefits to same sex, faux marriages.
There are plenty of people I love but wouldn’t marry. Besides, if you can have all the “red herring” rights that homosexuals love to talk about (hospital visits, designating anyone for your insurance, plug-pulling, and inheritance decisions) what’s the need for being called married?
