The student enrolled at Leona Vicario Elementary in the town of Cananea is technically a foreigner in his father's land. Oscar was born in Arizona and is a U.S. citizen. He can come back when he grows up1. He has nobody to blame for this temporary problem but his parents who didn't care enough to stop for a moment and think about his status.
1Assuming that the USA still exists as we know it by the year 2020 or thereabouts.

He can come back, or stay there, legally. Our laws say he was born here, he's welcome back. Their laws say his daddy determines his citizenship.
