Yes they can prosecute former military- retired or other separation designations if it is determined that the violations occurred while still on active duty. The military can and has yanked people back in to face prosecution. It is not common and I seriously doubt it would happen here but it is absolutely possible.
I assume it would usually be for serious violations, like theft or security issues.
