Yes. But remember, over 30 hours a week is considered “fulltime” under ObamaCare.

Sort of, the new way that they are determining if you have 50+ employees is by looking at your last 12 months. If at anytime during that last 12 months, they can count up enough part-time/casual workers to make the count 50+, you will be required to deal with Obamacare.

So if you are a florest shop, for example, and during your peak times, you end up hiring some part-time seasonal help, but for the rest of the time you have 40 employes, and your seasonal help kicks it over into 51 employes, you are doomed.

Any company that uses contingent workers should be taking a real close look at their payroll and how the government defines wether or not they have 50+ employees.

Rest assured, that's a goal post that'll get moved down to 25 or less. Full time work has already been re-defined to 29 hours.
