LA JOYA, TEXAS (AP) -- The Texas Department of Public Safety has released the name of the state trooper who fired on a fleeing pickup truck near the U.S.-Mexico border, killing two illegal immigrants who were hiding under a blanket in the bed.

The ACLU made the demand in a letter to Director Steve McCraw of the Texas Department of Public Safety, released Thursday that said, "If the facts as reported are true, this use of deadly force was illegal and unconstitutional."

A trooper aboard a DPS helicopter fired at the fleeing truck in an effort to disable it on Oct. 25.
Nine Guatemalan immigrants were in the truck, six of whom were hidden under a tarp in the bed.
Three were wounded and two died.
The letter demands an investigation by "an agency that is not under the umbrella of the Texas DPS."

How can the illegals say they know what the trooper would have seen or what he did not see ? Anything could be under that truck bedcover.Illegals will say anything to get greencards or large cash settlements.It's a shake down.
I don’t want helos firing down on civilian vehicles on “suspicion”. If they aren’t firing on others let the land crew stop them with tire stops. This was reckless behavior that ended in loss of life.
HIDALGO COUNTY - A14-year-old driver is wanted in connection with a chase that left two illegal immigrants dead north of La Joya.
Officials said the boy was driving a truck loaded with illegal immigrants when Texas Department of Public Safety troopers opened fire from the air.
The 14-year-old boy was in police custody after the incident, but was released to his parents hours later.
The chase started when Texas Parks and Wildlife Department game wardens spotted a suspicious vehicle. They tried to stop the truck but the driver refused to pull over and the chase ensued.
A TxDPS helicopter and troopers on the ground joined the pursuit, officials said.
A trooper aboard the helicopter opened fire on the truck bringing the chase to an end near FM 2221 and Mile 7 Road. Two immigrants died and two were injured.
Judge Jesse Contreras issued the arrest warrant for the teenager.

Illegals should not be entrusting their lives to 14 year old driver.
While I support most actions by border states to stem the flow, shooting from a helicopter, or any where else for that matter, is akin to murder.
The cartels are amping up their efforts and DPS is stepping up in Texas because Napolitano isn't getting the job done and she is tying the hands of her agents all along the SW border. These illegals got caught in the middle. Very unfortunate all around.
There was no justification for this, the DPS sniper murdered those illegals.

Looks like a lot of comments from liberals living well away from the combat zone, doesn’t it? They caught an illegal running a load of AK 47s from Dallas down to the front the other day.
With the feds ceding the territory, it’s up to Texas to defend itself.

Sorry but it’s hard to feel too much compassion when illegal aliens are harmed while engaged in the act of violating our nations sovereignty. I would suggest you reserved your anger for President Obama and his Administration for putting this tragedy in motion due to his unconstitutional actions and mandates. The blood is on his hands.
