Under Connecticut law, one must retreat, if possible, before using reasonable force while in their own residence. At this time, police believe that there is no evidence to charge Mirto with any crime. The evidence is being forwarded to the state attorneys office, which will conduct its own investigation and determine if Mirto acted with a legally-acceptable amount of force.
My note: A homeowner in my former Connecticut town shot himself in the foot while cleaning a gun in his own house and was charged with discharging a weapon within 500 feet of a residence. I don't know what happened with the case but it made the local newspaper.
At least the homeowner didn’t have to worry about concealed carry.
